1. Acceptance of Terms

E-Auctions India is an online e-auction discovery platform that aggregates publicly available bank auction listings in India. By accessing or using our website or mobile apps, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy and our Disclaimer.

You must be at least 18 years old and legally able to enter into a binding contract under Indian law to create an account.

We reserve the right to update these terms at any time. Continued use of the platform after changes constitutes your acceptance of the revised terms.

2. Nature of the Platform

E-Auctions India is an information aggregator only. We do not conduct, organise, or manage any auctions directly. All auction listings displayed on this platform are sourced from publicly available information provided by banks and financial institutions, including sale notices published under the SARFAESI Act, 2002 and allied recovery laws.

We are not an agent of, or affiliated with, any bank or auctioneer, we are not a party to any auction, and we earn no commission on any sale. E-Auctions India never requests cash or transfers to personal accounts — pay EMD only as directed in the official bank auction notice.

We do not guarantee the accuracy, completeness, or timeliness of any auction listing. Users must independently verify all details — including reserve prices, EMD amounts, auction dates, and property descriptions — directly with the relevant bank or auctioneer before participating in any auction.

3. User Accounts

To access certain features such as saving favourites, setting up auction alerts, or submitting listings, you must create an account — with your email address, or by signing in with Google or Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate and complete information when registering. We reserve the right to suspend or terminate accounts that violate these terms or are found to be fraudulent.

You may deactivate or delete your account at any time from your account settings, as described in our Privacy Policy.

4. Alerts and Notifications

Auction alerts, nearby-auction digests and gold/silver price alerts are a free convenience, sent on a best-effort basis. They may be delayed, incomplete or not delivered, and you should not rely on them as your only source of auction dates or deadlines.

5. Auctions You Submit

When you submit an auction for listing, you confirm that the information and documents you provide are accurate, relate to a genuine auction, and that you are entitled to share them. You grant E-Auctions India a free, non-exclusive licence to review, edit, publish and display that content on the platform.

We may verify, edit, reject or remove any submission at our discretion, without notice.

6. Gold and Silver Rates

Gold and silver rates shown on the platform are indicative, sourced from third-party providers, and may differ from rates offered by jewellers, banks or auctioneers. They are provided for information only and are not an offer to buy or sell.

7. Prohibited Use

You agree not to use E-Auctions India to:

• Scrape, copy, or republish auction listings without prior written permission
• Submit false or misleading auction listings
• Attempt to gain unauthorised access to other users' accounts or our systems
• Use the platform for any unlawful purpose or in violation of any applicable Indian law
• Transmit spam, malware, or any harmful code
• Impersonate any bank, financial institution, auctioneer or person, or use the platform to solicit payments from other users

8. Third-Party Links

Listings link to bank websites, e-auction portals and other third-party sites that we do not control. We are not responsible for their content, availability or practices, and your use of them is governed by their own terms.

9. Disclaimer of Warranties

E-Auctions India is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses.

We are not responsible for any financial loss, missed bidding opportunities, or other damages arising from reliance on information displayed on this platform. Always confirm auction details directly with the conducting bank or institution.

10. Limitation of Liability

To the maximum extent permitted by law, E-Auctions India and its operators shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of, or inability to use, this platform.

11. Indemnity

You agree to indemnify and hold harmless E-Auctions India and its operators from any claims, losses or expenses (including reasonable legal fees) arising from your breach of these terms, content you submit, or your misuse of the platform.

12. Intellectual Property

All content on E-Auctions India — including but not limited to the website design, logos, text, and software — is the property of E-Auctions India and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana, India.

14. Grievances

Complaints about content on the platform, or about these terms, may be sent to our Grievance Officer at [email protected]. We will acknowledge your complaint within 24 hours and resolve it within 15 days of receipt.
